1. Acceptance of Terms

By downloading, installing, or using Noctales ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

These Terms apply to all users of the App, including parents, guardians, and any other individuals who access the App on behalf of a child.

2. Who May Use the App

Noctales is intended for use by parents and guardians on behalf of children. You must be at least 18 years old to download and use the App. The App is designed to be used by adults for the benefit of children in their care — it is not intended to be operated directly by young children without parental supervision.

3. AI-Generated Content

Stories generated by Noctales are created by artificial intelligence based on the preferences and profile information you provide. By using the App, you acknowledge and agree that:

• AI-generated content may occasionally be unexpected, repetitive, or imperfect
• Generated stories are not reviewed, curated, or edited by Noctales before delivery
• You are responsible for reviewing stories before sharing them with your child
• Generated stories are intended for personal, non-commercial use only
• You may not reproduce, distribute, or publish generated stories for commercial purposes

4. Subscriptions and Purchases

Noctales offers free and paid subscription plans, as well as one-time in-app purchases. All transactions are processed by Apple through the App Store. By subscribing or making a purchase, you agree to Apple's App Store terms and payment policies.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions at any time in your Apple ID account settings.

Refunds are handled by Apple in accordance with their standard App Store refund policy. We do not issue refunds directly.

5. Acceptable Use

You agree not to use the App to:

• Generate content that is harmful, abusive, or inappropriate for children
• Attempt to reverse-engineer, modify, or exploit the App
• Use the App for any unlawful purpose
• Resell, sublicense, or commercially exploit the App or generated content
• Circumvent or disable any features or limitations of the App

6. Intellectual Property

The Noctales name, logo, design, and all original software are the intellectual property of Noctales. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Stories generated by the App are produced for your personal use. You retain no commercial rights to generated content, and Noctales retains no rights to the specific stories produced on your device.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranty of any kind. We do not guarantee that the App will be error-free, uninterrupted, or that AI-generated stories will meet any specific standard of quality or appropriateness. Use of the App is at your own discretion and risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Noctales shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data or dissatisfaction with generated content.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United States.
